Nicholas Robert Smalley pleaded guilty on Tuesday to a felony count of driving under the influence of alcohol or drugs, fourth or subsequent offense, pursuant to a plea agreement between the parties. Smalley’s attorney, Benjamin Darrow, advised that this agreement is part of a global agreement that will resolve Smalley’s additional pending charges in Missoula County. Judge Molly Owen set this matter for sentencing on September 24.
Appearing for a change of plea in his two pending criminal cases, after reaching a plea agreement, William Lucas Wyatt pleaded guilty to an amended felony charge of theft in one case and to two misdemeanor charges of resisting arrest and criminal mischief in a separte case. Sentencing was set for September 24 by Judge Owen.
Ronnie Maxwell Goodrum appeared for a second change of plea hearing, as the parties reached a new plea agreement after the original was rejected by Judge Owen. Goodrum entered a no contest plea to one amended felony count of criminal endangerment, with sentencing set for September 24.
Rodney George Marriott appeared before the court for sentencing. After some discussion between the parties, the victim stood before the court and read her victim impact statement, sharing information about her lengthy relationship and history with Marriott, the events that led to these charges, and the lasting impact the assault has had on her life. Marriott also addressed the court, admitting that his alcoholism “consumed his life for almost a decade and led to bad judgment and bad behavior.” Marriott stated that though the alcohol played a part in the events, it was no excuse for his actions, apologizing to the victim for his treatment of her. Pursuant to a plea agreement reached between the parties at mediation, Marriott was sentenced to a four year deferred imposition of sentence, with credit for time served of one day and probation conditions as set forth in the presentence investigation report. Marriott will also be required to pay restitution of $10,000 to the victim.
